SER Cura\u00e7ao advises Parliament on intern compensation, calls for clear rules on \u2018orphaned\u2019 legislation<\/span><\/h1>\n

WILLEMSTAD, July 29, 2025 \u2013 The Social and Economic Council (SER) of Cura\u00e7ao today issued advisory guidance at the request of Parliament concerning proposed legislation requiring companies to provide financial compensation to interns. The legislative proposal was initially introduced on May 5, 2025, by former Parliament member Gwendell Mercelina Jr. of the Partido Nashonal di Pueblo (PNP).<\/p>\n

In delivering its advice, the SER highlighted a notable procedural issue. The council pointed out that when Mercelina submitted his legislative initiative, he either knew or reasonably should have known he would not return as a Member of Parliament following the March 2025 general elections. Mercelina, indeed, did not retain his seat in the newly elected Parliament.<\/p>\n

Currently, Cura\u00e7ao has no explicit procedures governing how to proceed with legislative proposals when their original sponsor leaves office. The SER cited practices from the Netherlands, where the House of Representatives (Tweede Kamer) enables another legislator to adopt such proposals or allows them to lapse after a period of inactivity. This prevents proposals from becoming indefinitely stalled or \u2018orphaned\u2019.<\/p>\n

The SER therefore urged Cura\u00e7ao’s Parliament to consider establishing similar procedures. Implementing clear guidelines would help avoid legislative stagnation and ensure the responsible, transparent, and efficient handling of proposals in the legislative process.<\/p>\n

Besides procedural concerns, the council emphasized the significant societal and economic importance of establishing clear standards for internship compensation. Many young people in Cura\u00e7ao depend on internships to transition successfully from education into the workforce. The introduction of mandatory compensation could provide more equitable opportunities, especially benefiting students from financially vulnerable families, and help employers clearly understand their obligations.<\/p>\n

\u201cIntroducing fair compensation standards for internships is crucial to ensuring equal opportunities for all students, while providing clarity and predictability for businesses\u201d, the SER states.<\/p>\n

The advisory opinion will now inform Parliament\u2019s ongoing deliberation and consideration of the proposed legislation.<\/p>\n

SER-advies uit over initiatiefvoorstel tot herziening OZB-stelsel<\/span><\/h1>
Willemstad, 15 juli 2025 \u2013 De Sociaal-Economische Raad (SER) heeft op vrijdag 11 juli jongstleden een advies uitgebracht over de initiatiefontwerplandsverordening tot wijziging van de Landsverordening inzake de belastingheffing van onroerende zaken (Landsverordening onroerendezaakbelasting 2014). Het advies werd uitgebracht op verzoek van de Staten van Cura\u00e7ao.<\/p>
Het initiatiefvoorstel is afkomstig van de fractie van de MAN in de Staten, die zich hierbij beroept op het recht van initiatief zoals vastgelegd in artikel 77 van de Staatsregeling van Cura\u00e7ao (A.B. 2010, no. 86). Dit artikel verleent Statenleden de bevoegdheid om wetsvoorstellen zelfstandig in te dienen en aan de regering voor te dragen.<\/p>
Met het ontwerp beogen de indieners een herziening van het huidige OZB-stelsel, onder meer door aanpassing van de tariefstructuur, verhoging van de vrijstellingsdrempel en vereenvoudiging van de administratieve verwerking van de belasting op onroerende zaken.<\/p>
