\u201cWithout social safety, there is no true freedom\u201d<\/span><\/h1>\n

Bussum, June 20, 2025 \u2014 Addressing more than 900 certified confidential advisors, senior executives, and integrity and psychosocial\u2011safety professionals, Drs. Ra\u00fal Henriquez\u2014Director and Secretary\u2011General of te Social and Economic Council (SER) of Cura\u00e7ao \u2014delivered a compelling address<\/a> on Thursday, June 19, at the annual convention of the National Association of Confidential Advisors (LVV)<\/a>. The event, held at the Aalt Convention Center in Bussum, Netherlands, focused on framing social safety as the indispensable foundation of good governance.<\/p>\n

At the invitation of LVV Chair Mrs. Ingrid te Brake, Henriquez emphasized, \u201cThe confidential advisor is not a passive complaint handler but an active guardian of human dignity, institutional justice, and\u2014let there be no mistake\u2014the legitimacy of organizations in both the public and private sectors.\u201d He applauded the congress theme\u2014 \u201cThe Confidential Advisor in Motion: Moving Toward Proactivity\u201d\u2014as a sign of strategic foresight.<\/p>\n

Henriquez warned that these challenges transcend geographic boundaries. \u201cIn Cura\u00e7ao\u2014and, mutatis mutandis, in Aruba, Sint Maarten, and the public bodies of Caribbean Netherlands\u2014the same systemic vulnerabilities emerge throughout the Kingdom,\u201d he asserted. \u201cSilence, cultures of fear, informal loyalty pressures, and a dearth of safe, accessible reporting structures plague all.\u201d He noted that in smaller societies, social proximity can suppress willingness to speak up, rendering the role of a trained, independent confidential advisor more critical than ever.<\/p>\n

Framing social safety as a pillar of the social contract, Henriquez stressed, \u201cThe right to a safe, respectful, and integrity\u2011driven workplace is not a voluntary statement\u2014it is a legal norm, rooted in international agreements such as the Convention of the International Labour Organization (ILO) No.\u202f190 and the Tripartite Declaration on Multinational Enterprises and Social Policy.\u201d<\/p>\n

He highlighted Stop the Silence<\/em>, a book presented to the SER of Cura\u00e7ao, and its sequel, The Proactive Confidential Advisor<\/em>, as indicative of a broader cultural shift. \u201cThese works signal a move from incident\u2011driven responses to preventive ethical leadership. Prevention is institutionally superior to cure and requires structural investment in knowledge exchange, standard\u2011setting, and professional certification,\u201d Henriquez emphasized. He underscored that confidential advisors deserve a strategic place in governance and compliance\u2014not merely as an appendage of HR policy.<\/p>\n

Turning to broader societal implications, Henriquez called for concerted action: \u201cLet us not only coordinate on policy but also converge ethically. Together, we must strive toward an intraregional legal and values framework that firmly anchors and sustainably empowers the confidential advisor.\u201d<\/p>\n

His address concluded with a resonant refrain: \u201cWithout social safety, there is no true freedom.\u201d<\/p>\n

SER brengt advies uit over ontwerp minimumbelasting Cura\u00e7ao<\/span><\/h1>

WILLEMSTAD, 20 mei 2025 \u2013 De Sociaal-Economische Raad (SER) heeft op maandag 19 mei jongstleden een formeel advies uitgebracht aan demissionair minister van Financi\u00ebn Javier Silvania over de ontwerplandsverordening minimumbelasting 2025. Het wetsontwerp beoogt de invoering van een effectieve minimumbelasting van 15 procent op de winst van groepsentiteiten binnen multinationale ondernemingen met een wereldwijde jaaromzet van ten minste 750 miljoen euro. Hiermee sluit Cura\u00e7ao aan bij de internationale afspraken zoals vastgelegd in het zogenoemde Pijler 2-raamwerk van de Organisatie voor Economische Samenwerking en Ontwikkeling (OESO).<\/p>
Het wetsvoorstel werd eind 2024 aangekondigd en is in december van dat jaar formeel aangeschreven aan de Staten van Cura\u00e7ao, die destijds instemden met het voornemen tot invoering. Met het recente SER-advies is een volgende stap gezet in het wetgevingsproces. De landsverordening vereist nog formele parlementaire goedkeuring. Als de Staten akkoord gaan, zal de regeling in werking treden met terugwerkende kracht tot 1 januari 2025.<\/p>
De voorgestelde belastingmaatregel is gericht op het waarborgen van een minimumniveau van belastingheffing in Cura\u00e7ao. Daarmee wordt voorkomen dat belastinggrondslagen weglekken naar andere jurisdicties die wel bijheffingsmaatregelen toepassen. Tegelijkertijd sluit het voorstel aan bij een bredere internationale beweging tegen schadelijke belastingconcurrentie.<\/p>
De SER heeft ervoor gekozen het adviestraject gefaseerd en planmatig op te bouwen. Die benadering was ingegeven door de toenemende geopolitieke onzekerheid, in het bijzonder als gevolg van het gewijzigde fiscale beleid van de Verenigde Staten onder president Donald J. Trump, die sinds januari dit jaar opnieuw het Witte Huis bezet. De Amerikaanse regering heeft inmiddels te kennen gegeven kritisch te staan tegenover internationale belastingregels die als extraterritoriaal of discriminerend jegens Amerikaanse bedrijven worden beschouwd. Mocht de minimumbelasting ongunstig uitpakken voor Amerikaanse multinationals, loopt Cura\u00e7ao het risico mogelijkerwijs geconfronteerd te worden met wederkerige belastingmaatregelen vanuit Washington.<\/p>
Voor de SER vormden deze ontwikkelingen aanleiding om bijzondere aandacht te besteden aan diplomatieke positionering, timing en uitvoerbaarheid van het voorstel. De SER acht het van belang dat Cura\u00e7ao zijn fiscale stelsel moderniseert, maar tegelijkertijd ruimte behoudt voor aanpassing als de internationale verhoudingen daarom vragen.<\/p>
